These Terms & Conditions (“Terms”) apply to all purchases made through shop.bartspruit.nl (the “Shop”). By placing an order, you agree to these Terms.

2) Scope and definitions
- Consumer: a natural person acting outside their trade, business, craft or profession.
- Digital Product: downloadable files (e.g., PDF sheet music, eBooks) not supplied on a tangible medium.
- Video Access / Membership: access to video lessons or an online members area, including time-limited access (e.g., 1 year).
- Physical Product: printed books or other tangible goods (if offered).
If a product page conflicts with these Terms, the product page information prevails for that specific product.
3) Products and product information
We sell:
- Digital Products (PDF/eBook downloads)
- Video Access / Memberships (including access bundled with certain products)
- Physical Products (where explicitly offered)
We take reasonable care to describe products accurately. Minor differences in layout, colors on screens, or formatting caused by device/printer settings are not considered defects.
4) Prices, currency, and taxes
- Prices are shown in the currency displayed on the product page and/or checkout.
- VAT/taxes are calculated at checkout based on your billing location and applicable rules.
- Any additional costs (e.g., shipping for Physical Products) are shown at checkout before payment.
5) Order and payment
- An order is placed when you complete checkout and payment is successfully processed.
- Payment is due immediately at checkout using the payment methods offered.
- You will receive an order confirmation by email.
We may refuse or cancel an order in cases of clear pricing errors, fraud, abuse, or payment issues. If payment was taken and we cancel the order, we will refund the paid amount.
6) Delivery
6.1 Digital Products (downloads)
- Digital Products are delivered electronically via download link and/or email after successful payment.
- You are responsible for providing a valid email address and ensuring you can receive emails (including checking spam/junk folders).
- If you cannot access your download, contact [email protected] with your order details. We will provide reasonable assistance to restore access.
6.2 Video Access / Membership
- Access is granted to the email/account used during checkout.
- Access duration is as stated on the product page (e.g., 1 year from purchase date).
- We may perform maintenance that temporarily affects availability. We aim to keep downtime minimal.
6.3 Physical Products (if applicable)
- Delivery times and shipping costs (if any) are shown at checkout.
- Risk of loss/damage transfers to the Consumer upon delivery to the Consumer or a third party designated by the Consumer.
7) License, permitted use, and intellectual property (Digital Products & Videos)
All Digital Products and Video content are protected by copyright and remain the property of Bart Spruit (or licensors).
7.1 Personal license
Unless stated otherwise, you receive a non-exclusive, non-transferable personal license to:
- Download and use Digital Products for personal practice and performance.
- Print copies for your personal use.
7.2 Prohibited use
You may not:
- Share, upload, distribute, resell, sublicense, or make the files publicly available (including in groups, forums, cloud folders, file-sharing sites).
- Remove copyright notices or claim authorship.
- Use the content for mass reproduction, commercial resale, or redistribution.
7.3 Teaching use (choose your policy; this version is strict + safe)
Teachers may demonstrate excerpts in lessons, but students must purchase their own copy for practice and performance. Systematic copying for classes/studios is not permitted.
8) Consumer right of withdrawal (EU/EEA)
If you are an EU/EEA Consumer, you generally have a 14-day right of withdrawal for distance purchases, unless an exception applies.
8.1 Digital content exception (downloads)
For Digital Products (digital content not supplied on a tangible medium), your right of withdrawal may be lost once delivery starts, if:
- you give explicit consent to immediate delivery, and
- you acknowledge that you lose your right of withdrawal once delivery has begun.
By purchasing Digital Products in our checkout, you will be asked to confirm these points (e.g., via a required checkbox). If you do not consent, we may not be able to deliver the Digital Product immediately.
8.2 Video Access / Membership
If Video Access begins immediately after purchase, the same principles may apply (depending on how the service is delivered and local mandatory rules). Where required by law, we will provide the appropriate withdrawal information at checkout.
8.3 Physical products (if applicable)
For Physical Products, the withdrawal period starts on the day you (or a third party you designate) receive the goods.
9) Refunds and returns
9.1 Digital Products
Because Digital Products are delivered instantly and cannot be “returned” in a meaningful way, we generally do not offer refunds after delivery has started, except where required by law.
However, if:
- the wrong file was delivered, or
- the download link/access fails and we cannot reasonably fix it,
we will provide a replacement, restored access, or (if necessary) a refund.
9.2 Video Access / Membership
Refunds for Video Access/Memberships follow:
- the terms shown at checkout, and
- mandatory consumer law.
If you have access issues, contact [email protected] first; we will attempt to resolve the problem promptly.
9.3 Physical products (if applicable)
If you receive a damaged or incorrect Physical Product, contact us within 14 days of delivery with your order number and photos. We will offer an appropriate solution (replacement or refund where applicable).
If you exercise a valid withdrawal right for Physical Products, you are responsible for returning the goods unless stated otherwise. Refunds are processed after we receive the returned item or proof of return.
10) Technical requirements and user responsibility
You are responsible for ensuring you have compatible devices/software to access:
- PDF/eBook files (a standard PDF reader is sufficient), and
- Video content (a modern browser and stable internet connection).
We are not liable for issues caused by your device, printer, software, internet connection, email provider, or failure to follow instructions.
11) Support
Support is provided via [email protected].
We aim to respond within 2 business days (often faster).
12) Fraud, chargebacks, and misuse
If a chargeback is initiated or we detect fraud/misuse, we may:
- suspend access to Digital Products and/or Video Access related to the order, and/or
- refuse further service.
Suspension may remain until the dispute is resolved.
13) Liability
To the maximum extent permitted by law:
- We are not liable for indirect or consequential damages (including loss of profits, loss of data, or business interruption).
- Our total liability for any claim is limited to the amount paid for the relevant product or service.
Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., for intentional misconduct or gross negligence where relevant).
14) Complaints and disputes
If you have a complaint, contact [email protected] with your order details. We will try to resolve complaints promptly and reasonably.
15) Changes to these Terms
We may update these Terms from time to time. The version applicable to your order is the version available at the time of checkout.
16) Governing law and jurisdiction
These Terms are governed by the laws of The Netherlands.
